AH Management (trademark of Eclohesion) is the training provider.
The CLIENT is the company for which the training is provided.
Registration instructions:
Registration will be considered complete upon receipt of the completed and signed registration form, returned to the training organization by mail or email to the address provided. From the date the registration form is signed, the customer has a 10-day cancellation period. In the event of cancellation, the customer must notify the training organization by certified mail.
Prices:
Prices are subject to the applicable VAT rate at the time of billing.
The price for an in-house training course includes the training and course materials.
The price for an open-enrollment training course includes the training, course materials, meals, and the rental of the training room.
Cases where costs are covered by an OPCO:
PLEASE NOTE: If the Client wishes for payment to be made by the OPCO under whose jurisdiction they fall, it is their responsibility to submit a request for coverage before the training begins and to ensure that this request is successfully processed. It is also the Client’s responsibility to explicitly indicate this on their registration form.
The training provider also agrees to submit attendance certificates and any other documents requested by the OPCO or any other organization responsible for funding the training. An attendance certificate is issued to the trainee at the end of the training.
Subrogation:
In the event of a payment subrogation agreement between the client and the OPCO, or any other organization, the training provider will forward the invoices to the OPCO, or any other organization, which will inform the client of the specific payment terms.
In any case, the client agrees to pay the training provider the difference between the total cost of the training courses listed on the registration form and the amount covered by the OPCO or any other organization.
The training organization will send the client monthly invoices for payment of the additional amount mentioned in the preceding paragraph.
In the event of a change to the funding agreement by the OPCO or any other organization, the client remains liable for the portion of the training costs not covered by said organization.
Payment terms:
Payments are due upon receipt of a monthly invoice. The contractually agreed payment dates may not be unilaterally altered by the Customer under any circumstances, including in the event of a dispute.
Late payment penalties begin to accrue after a formal notice is sent by certified mail with return receipt requested.
Late payment penalties are calculated based on the interest rate applied by the European Central Bank to its most recent refinancing operation, plus 10 percentage points.
Changes to dates made by the training organization:
In order to ensure the right mix of participants, the training provider may propose changes to the dates. If the number of participants is insufficient for the session to proceed effectively, the training provider reserves the right to postpone or reschedule the training without compensation. Notification of such a decision will be provided no later than one week before the scheduled start date of the training.
Cancellation due to force majeure:
In the event of force majeure, the organization reserves the right to cancel the training without compensation to the client.
All events resulting from the COVID-19 pandemic that may affect the organization of a training session are covered by this clause, including:
– Inability to hold the training due to government, prefectural, or other regulations;
– A confirmed or suspected case of Covid-19 among the trainers;
– A confirmed case of Covid-19 among the trainer’s close contacts, resulting in the trainer being required to quarantine.
Request to reschedule or cancel:
Any module that has been started must be paid for in full.
Any request to reschedule or cancel a training session will affect the course of the training. In the event of a duly documented force majeure situation, we offer the client the option to replace the participant who is unable to attend with another person who meets the prerequisites at any time. If this option is not possible, we ask the client to contact us as soon as possible so that we can find a solution.
The cancellation fees are as follows:
100% of the total price in the event of cancellation 4 business days or fewer before the start of the training.
75% of the total price in the event of cancellation between 5 and 9 business days before the start of the training.
50% of the total price in the event of cancellation between 10 and 30 business days before the start of the training.
Under no circumstances may these costs be deducted from the amount of the vocational training grant.
In such cases, it is possible to replace one participant with another or reschedule the event once at no additional cost.
Legal documents:
The invoice/agreement and the attendance sheet are sent with the billing. A certificate of completion is sent after the training.
Potential disputes:
In the event of a dispute and if an amicable settlement cannot be reached, only the courts within the jurisdiction of the training organization shall have jurisdiction.
